BCF Recovery & Transport applies the following general terms and conditions, depending on the nature of the service:

• General Recovery and Transport Conditions for Stranded Vehicles (ABVV) for roadside assistance and towing service.
• General Transport Conditions (AVC) for national vehicle transport.
• Fenex Dutch Storage Conditions for storage and warehousing of vehicles.

1. Applicability

These general terms and conditions apply to all offers, quotations, agreements, and deliveries of services by BCF Recovery & Transport, unless expressly agreed otherwise in writing.

The applicability of any purchase or other conditions of the client is expressly rejected.

2. Definitions

In these terms, the following definitions apply:

**BCF**: BCF Recovery & Transport, located in Heerenveen.

**Client**: the natural or legal person who enters into an agreement with BCF.

**Services**: all work performed by BCF, including roadside assistance, towing service, heavy-duty recovery, vehicle transport, and replacement vehicle.

3. Offers and Agreements

All offers from BCF are non-binding, unless otherwise stated.

An agreement is concluded at the moment the client accepts BCF's offer in writing or orally, or when BCF begins performing the services.

4. Performance of Services

BCF will perform the services to the best of its knowledge and ability and in accordance with the requirements of good craftsmanship.

BCF has the right to have certain work performed by third parties.

The client ensures that all data, which BCF indicates are necessary or which the client can reasonably understand to be necessary for the execution of the agreement, are provided to BCF in a timely manner.

5. Prices and Payment

All prices are exclusive of VAT, unless otherwise stated.

Payment must be made within 14 days of the invoice date, in a manner indicated by BCF.

In case of late payment, the client is legally in default, and BCF is entitled to charge the statutory interest.

6. Liability

BCF is solely liable for direct damage resulting from an attributable shortcoming in the performance of the agreement.

BCF's liability is limited to the amount paid out by BCF's liability insurance in the relevant case, plus the deductible.

BCF is never liable for indirect damage, including consequential damage, loss of profit, missed savings, and damage due to business interruption.

7. Force Majeure

BCF is not obliged to fulfill any obligation if it is hindered from doing so due to a circumstance not attributable to its fault, nor for which it is responsible by virtue of law, legal act, or generally accepted views.

In these general terms and conditions, force majeure is understood to mean, in addition to what is understood in law and jurisprudence, all external causes, foreseen or unforeseen, over which BCF has no influence, but which prevent BCF from fulfilling its obligations.

8. Complaints

Complaints about the performance of the agreement must be submitted to BCF fully and clearly described within a reasonable time after the client has discovered the defects.

Complaints submitted to BCF will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, BCF will respond within the 14-day period with an acknowledgment of receipt and an indication of when the client can expect a more detailed answer.

9. Applicable Law and Disputes

Dutch law exclusively applies to all legal relationships to which BCF is a party, even if an obligation is wholly or partially performed abroad or if the party involved in the legal relationship resides there.

The court in BCF's place of establishment has exclusive jurisdiction to hear disputes, unless the law mandatorily prescribes otherwise.

10. Amendment of the Terms

BCF reserves the right to amend or supplement these general terms and conditions at any time.

Changes take effect at the moment of publication on BCF's website or at the moment the client has been informed thereof.
