General Terms and Conditions BCF Roadside Assistance

Below you will find the General Terms and Conditions of BCF Roadside Assistance. These conditions apply to all services provided by BCF Roadside Assistance.

BCF Roadside Assistance is a trade name of BCF Roadside Assistance B.V., located at Saturnus 1, 8448 CC Heerenveen, registered with the Chamber of Commerce under number 87654321.

These General Terms and Conditions apply to all offers, quotations, and agreements between BCF Roadside Assistance and the client, unless expressly agreed otherwise in writing.

By using the services of BCF Roadside Assistance, the client agrees to these General Terms and Conditions.

Chapter 1: Definitions and Applicability

Article 1: Definitions In these General Terms and Conditions, the following terms shall have the meanings ascribed to them below: 1. BCF Roadside Assistance: BCF Roadside Assistance B.V. 2. Client: the natural or legal person who uses the services of BCF Roadside Assistance. 3. Services: all activities performed by BCF Roadside Assistance in the context of roadside assistance, towing service, transport, and replacement vehicle. 4. Vehicle: the motor vehicle or trailer for which the services are provided. 5. Roadside Assistance: assistance in case of vehicle immobility due to breakdown, accident, or other cause. 6. Towing Service: the towing away of a vehicle after an accident or breakdown. 7. Replacement Vehicle: a temporary vehicle made available to the client.

Article 2: Applicability 1. These General Terms and Conditions apply to all offers, quotations, and agreements between BCF Roadside Assistance and the client. 2. Deviations from these conditions are only valid if expressly agreed upon in writing. 3. The applicability of any purchase or other conditions of the client is expressly rejected.

Chapter 2: Execution of Services

Article 3: Execution 1. BCF Roadside Assistance will perform the services to the best of its knowledge and ability and in accordance with the requirements of good craftsmanship. 2. BCF Roadside Assistance has the right to have certain activities performed by third parties. 3. The client must provide all necessary cooperation to BCF Roadside Assistance for the execution of the services.

Article 4: Terms 1. Stated terms for the execution of the services are indicative and never strict deadlines. 2. Exceeding a term does not entitle the client to compensation or dissolution of the agreement.

Chapter 3: Prices and Payment

Article 5: Prices 1. All prices are exclusive of VAT, unless otherwise stated. 2. BCF Roadside Assistance has the right to adjust prices. Price adjustments will be communicated in a timely manner.

Article 6: Payment 1. Payment must be made within 14 days of the invoice date, unless otherwise agreed. 2. In case of late payment, the client is legally in default and owes interest of 1% per month. 3. All judicial and extrajudicial collection costs shall be borne by the client.

Chapter 4: Liability

Article 7: Liability 1. BCF Roadside Assistance is only liable for direct damage resulting from an attributable shortcoming in the performance of the agreement. 2. The liability of BCF Roadside Assistance is limited to the amount paid out by BCF Roadside Assistance's liability insurance in the relevant case, plus the deductible. 3. BCF Roadside Assistance is never liable for indirect damage, including consequential damage, loss of profit, missed savings, and damage due to business interruption.

Chapter 5: Other Provisions

Article 8: Force Majeure 1. BCF Roadside Assistance is not obliged to fulfill any obligation if it is hindered by a circumstance not attributable to its fault, nor for its account by virtue of law, legal act, or generally accepted views. 2. Force majeure is understood to mean, in addition to what is understood in law and jurisprudence, all external causes, foreseen or unforeseen, over which BCF Roadside Assistance has no influence, but which prevent BCF Roadside Assistance from fulfilling its obligations.

Article 9: Complaints 1. Complaints about the execution of the agreement must be submitted in writing and with reasons to BCF Roadside Assistance within 7 days after discovery, but no later than 14 days after completion of the relevant service. 2. Complaints do not suspend the client's payment obligation.

Article 10: Applicable law and choice of forum 1. All agreements between BCF Roadside Assistance and the client are exclusively governed by Dutch law. 2. All disputes that may arise as a result of an agreement to which these conditions apply will be settled by the competent court in the Noord-Nederland district, location Leeuwarden.
